Welcome to Type The Rhythm! These Terms of Service ("Terms") govern your access to and use of the Type The Rhythm website and game (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By using the Service, you confirm that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. To create an account, you must be at least 13 years of age.

2. Description of Service

Type The Rhythm is a browser-based rhythm typing game. The Service includes a free tier with access to a limited selection of songs, and a paid tier that unlocks additional songs and content.

3. Accounts

3.1 Account Creation

You may play the game without creating an account. However, to save your progress, you may create an account using a magic email link or by authenticating through Apple, Google, or Facebook. You must be at least 13 years old to create an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. You may delete your account at any time by contacting us.

4. Payments and Subscriptions

4.1 Paid Content

The Service offers paid content that unlocks additional songs. All purchases are processed through third-party payment providers. By making a purchase, you agree to the payment provider's terms of service.

4.2 Refunds

Refund policies are subject to the terms of the applicable payment provider and any applicable laws. Please contact us if you have questions about a specific purchase.

5. Intellectual Property

All content, features, and functionality of the Service—including but not limited to text, graphics, logos, audio, and software—are owned by Type The Rhythm or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

6. Prohibited Conduct

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to the Service or its related systems; (c) interfere with or disrupt the Service; (d) use bots, scripts, or automated methods to interact with the Service; or (e) circumvent any access controls or usage limits.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TYPE THE RHYTHM AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless Type The Rhythm and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

10. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
